Neoconstitucionalismo ambiental y eco-diplomacia: la incidencia de los instrumentos internacionales en la legislación ecuatoriana en el periodo 2008-2018

Abstract

En el presente trabajo se podrá dar a conocer una breve comparación de los instrumentos nacionales con los instrumentos internacionales, que aportan para la creación de normas y leyes a favor de la naturaleza en Ecuador, evidenciando con artículos de la Constitución del 2008, los artículos relevantes que engloben la importancia de los recursos naturales y el medio ambiente como sujeto de derecho. Con bases de esta nueva corriente, el Neo Constitucionalismo Ambiental, ayuda a analizar y comparar los artículos, afirmando que en Ecuador si existe la buena fe para trabajar a favor de los derechos. Además de iniciar con un antecedente de como las decisiones de un gobernador afectan la vigencia de la Constitución ya que desea acomodar una corriente más pacifista, en la que primaba la protección a todo lo que sea nacional, desde productos y recursos. Culminando con la demostración de cómo la administración pública en Santo Domingo de los Tsáchilas intenta adquirir el nuevo termino de eco diplomacia, pero lo terminan convirtiendo más en un tema burocrático, lleno de pasos y normas por cumplir, sin actuar de manera inmediata para defender a la naturaleza de todo aquello que pueda interferir para su bienestar. In this paper we will present a brief comparison of national instruments with international instruments, which contributed to the creation of rules and laws in favor of nature in Ecuador, showing with articles of the Constitution of 2008, the relevant articles that encompass the importance of natural resources and the environment as a subject of law. Based on this new current, Environmental Neo-Constitutionalism, helps to analyze and compare the articles, affirming that in Ecuador there is good faith to work in favor of environmental rights. In addition to starting with a background of how the decisions of a governor affect the application of the Constitution, as it wishes to accommodate a more pacifist current, in which the protection of all that is national, from products and resources prevailed. Culminating with the demonstration of how the public administration in Santo Domingo de los Tsáchilas tries to acquire the new term of eco diplomacy, but end up turning it more into a 2 bureaucratic issue, full of steps and rules to comply with, without acting immediately to defend nature from anything that might interfere with its welfare.
