Estudio del delito de maltrato animal a partir de su tipicidad en la legislación ecuatoriana

Abstract

Ecuador como Estado constitucional de derechos y de justicia, velará por el cumplimiento y la protección de quienes han sido calificados como sujetos del derecho en la Constitución, actualmente la Naturaleza es considerada sujeta de Derechos en tanto a su estrecha interrelación del ser humano con los animales, se da en virtud de la Reforma Penal Ecuatoriana respecto al Maltrato Animal y su roll ante esta problemática. En vista a los planteamientos, charlas políticas y las varias acciones legales instauradas por distintas organizaciones y colectivos sociales, ante el paradigma del estatus jurídico de los animales no humanos, y la evidente preocupación colectiva por su bienestar, tomando en cuenta que, a lo largo del tiempo los animales han formado parte de la vida diaria de los seres humanos, tanto en el trabajo, industria y compañía, pese a que ellos han adquirido en este transcurso de tiempo ciertos derechos, en virtud y referente a la Constitución de la República del Ecuador del 2008, nuestro Código Civil aún considera al animal como un bien jurídico, un semoviente que a la fecha de hoy, no se puede reformar el artículo 585 del Código Civil. Ecuador as a constitutional State of rights and justice, Will ensure the compliance and protection of those who have been qualified as subjects of the right in the Constitution, currently the close interrelation of human beings with animals is given by virtue of the Ecuadorian Penal Reform regarding to Animal Abuse and its role in the face of this problem, in view of the proposals, political talks and the various legal actions instituted by different organizations and social groups, in the face of the paradigm of the legal status of non-human animals and the evident collective concern for their well-being , taking into account that, over time, animals have been part of the daily life of human beings, both at work, industry and company, despite the fact that they have acquired certain rights in this course of time, in virtue and referring to the Constitution of the Republic of Ecuador of 2008, our Civil Code still considers the animal as a good legal, a semoviente that to date, article 585 of the Civil Code cannot be amended.
