Análisis jurídico de los derechos de autor en el ámbito cultural artístico en el Ecuador

Abstract

El presente artículo pretende analizar la protección jurídica que se otorga a la titularidad de las obras artísticas, asimismo se busca examinar desde cuándo se logró institucionalizar los derechos de autor a través de una revisión histórica, hasta llegar a determinar los mecanismos que amparan a los derechos de autor en el ordenamiento jurídico ecuatoriano con el Código Orgánico de la Economía Social de los Conocimientos (COESCCI), finalmente se establecerá mediante derecho comparado con legislación mexicana y peruana lo que puede optimizar el ejercicio de derechos de autor en el marco jurídico del Ecuador. Para lograr dicho fin se ha empleado el método analítico, sintético, inductivo, deductivo e histórico, mediante un enfoque cualitativo obtenido de revisión bibliográfica de libros, revistas y documentos académicos, a más de haber realizado encuestas y entrevistas, herramientas que me han permitido justificar el porqué es importante un avance de los derechos de autor en el país. This article aims to analyze the legal protection granted to the ownership of artistic works, also seeks to examine since when it was possible to institutionalize copyright through a historical review, to determine the mechanisms that protect copyright in the Ecuadorian legal system with the Organic Code of the Social Economy of Knowledge (COESCCI), finally it will be established through comparative law with Mexican and Peruvian legislation that can optimize the exercise of copyright in the legal framework of Ecuador. In order to achieve this purpose, the analytical, synthetic, inductive, deductive and historical method has been used, through a qualitative approach obtained from a bibliographic review of books, magazines and academic documents, in addition to having conducted surveys and interviews, tools that have allowed me to justify why it is important to advance copyright in the country.
