Responsabilidad derivada de los delitos y cuasidelitos civiles realizados por entes autónomos programados

Abstract

A medida que el avance tecnológico se acelera y la inteligencia artificial se vuelve una parte más común de la vida diaria, es necesario definir cómo el derecho deberá responder ante las múltiples interrogantes que plantea la nueva interacción entre seres humanos y entes que, en teoría, pueden actuar de manera autónoma. Entre estas está la cuestión de qué pasa cuando uno de estos entes comete un daño a la persona o propiedad de alguien. A lo largo de este trabajo se examinará la autonomía de estos entes, qué significa la misma para la determinación de responsabilidad cuando existe una acción dañina perpetrada por alguno; todo finalmente para poder establecer quién debe hacerse responsable por los daños ocasionados por los mismos. As technology marches forward ever faster and artificial intelligence becomes more common and entrenched in daily life, it becomes necessary to define how the law and its practitioners must respond to the multiple questions that arise from the new interactions between human beings and these new entities that, at least in theory, can and do act in an independent and autonomous manner. Among these queries is the one that refers to what happens when one of these entities harms a person or their property. Throughout this work the autonomy of these beings will be examined, its existence and what it means for the determination of responsibility when harm is done by them will be analysed and finally that same responsibility for any damage that results from their actions will be determined.
