Rendición de cuentas ¿una vía para garantizar el principio del interés superior del niño

Abstract

La incorporación de la figura de rendición de cuentas en el Código de la Niñez y Adolescencia como un modo de garantizar el principio del Interés Superior del Niño ha sido objeto de mucha crítica y debate. El presente artículo a través de un estudio cualitativo muestra la necesidad de evaluar y dar seguimiento al debido cumplimiento de este principio y se cuestiona si el Ecuador a través de su normativa y políticas implementadas en materia de niñez y adolescencia son suficientes para dar cumplimiento a lo establecido en las Observaciones Generales emitidas por la Organización de las Naciones Unidas, así como la normativa especial. Al final del trabajo se establece la importancia de rendir cuentas sobre el dinero de la pensión alimenticia, dado que existen casos donde no existe certeza del buen manejo del dinero por parte de la persona quien administra, ni tampoco seguridad sobre el pleno ejercicio de los derechos de los niños, niñas y adolescentes. The incorporation of the accountability figure in the Childhood and Adolescence Code to guarantee the principle of the Best Interest of the Child has been the subject of much criticism and debate. This article, through a qualitative study, highlights the importance of evaluating and monitoring the proper compliance with this principle and questions whether Ecuador, through its regulations and policies implemented in the field of childhood and adolescence, is sufficient to comply with what is established in the General Comments issued by the United Nations, as well as the special regulations. At the end of the study, the importance of being accountable for child support money is established, given that there are cases where there is no certainty about the proper management of the money by the person in charge, nor any assurance about the full exercise of the rights of children and adolescents.
