Abstract: El presente trabajo de investigación se centra en analizar la no reincidencia dentro de la institución jurídica de la Suspensión Condicional de la Pena (reconocida en el artículo 631, numeral 9 del Código Orgánico Integral Penal del Ecuador), y su armonía o discordancia con los preceptos constitucionales de igualdad y no discriminación. Esta investigación demostrará que, a lo largo de la historia, las Personas Privadas de la Libertad han constituido un grupo que ha sufrido vejaciones a sus derechos por su condición propia, y además, son y han sido objeto de una latente discriminación legal y estatal. Por lo tanto, precautelando los derechos y garantías constitucionales, reconocidas además por instrumentos internacionales de Derechos Humanos, cualquier norma que discrimine a las Personas Privadas de la Libertad, debe ser analizada y depurada de nuestro sistema legal. The present research work is focused on analyzing the non-recidivism within the legal institution of the Conditional Suspension of the Sentence (recognized in the article 631, numeral 9 of the Código Orgánico Integral Penal del Ecuador) and if it’s attached or not to the constitutional precepts of equality and non-discrimination. This investigation will demonstrate that, throughout history, Persons Deprived of Liberty have constituted a group that has suffered violations of their rights due to their own condition, and, in addition, they are victims of a legal and state discrimination. Therefore, safeguarding constitutional rights and guarantees, also recognized by international Human Rights instruments; any norm that discriminates Persons Deprived of Liberty must be analyzed and purged from our legal system.
