Mercado de futuros de agua en Ecuador – análisis jurídico sobre su posible implementación

Abstract

El agua es un recurso vital para la supervivencia de todos los seres vivientes. Al ser un recurso limitado en el planeta, existe una creciente preocupación por su disponibilidad y accesibilidad actual y futura. Cada vez más, existen mayores preocupaciones climáticas, una población que va en aumento y una producción agrícola que sigue creciendo. Es por este motivo que, como iniciativa privada dirigida a mejorar la gestión del agua, a finales del 2020 en el estado de California el agua comenzó a cotizar en el mercado de futuro de materias primas, tal como sucede con el oro o el petróleo. Como consecuencia de esto, el valor del agua será susceptible de cambios y variaciones, como cualquier otro producto que cotiza en bolsas de valores. Es fundamental en el presente trabajo de investigación tener en cuenta que, el Estado tiene el derecho de administrar los sectores estratégicos del país, y el agua es, conforme a la Constitución, un recurso estratégico. Al ser innegable esta realidad que viven los mercados mundiales, es fundamental realizar un análisis sobre marco normativo que regula el mercado bursátil que existe en el Ecuador. De esta manera, se podrá llegar a determinar si el actual marco normativo ecuatoriano permite o no adaptarse a lo que está sucediendo en el mundo con relación a sus mercados, puntualmente el mercado de los futuros de agua. Es de suma importancia hacer un análisis de los derivados financieros que actualmente se ofrecen en el mercado bursátil del país, puntualmente los futuros. Cuando en un mercado bursátil se comercia un contrato de futuro, se está comprometiendo la compra o venta de una materia prima que debe ser entregada en cierta fecha. Mediante la presente investigación, se pretende llegar a determinar si el mercado bursátil ecuatoriano está en capacidad de comerciar este tipo de contratos y de que forma hacerlo. Se llegará a demostrar cuales son las actuales falencias que se presentan en el mercado para poder llegar a hacerlo, y los beneficios que esto podría representar para el país. Because of this, the value of water will be subject to changes and variations, like any other product that is listed on the stock exchanges. It is essential in this research work to consider that the State has the right to administer the strategic sectors of the country, and water is, according to the Constitution, a strategic resource. As this reality that world markets live is undeniable, it is essential to carry out an analysis on the regulatory framework that regulates the stock market that exists in Ecuador. In this way, it will be possible to determine if the current Ecuadorian regulatory framework allows or not to adapt to what is happening in the world in relation to its markets, specifically the water futures market. It is very important to make an analysis of the financial derivatives that are currently offered in the country's stock market, specifically the futures. When a futures contract is traded in a stock market, the purchase or sale of a raw material that must be delivered on a certain date is being committed. Through this investigation, it is intended to determine if the Ecuadorian stock market can trade this type of contracts and in what way to do it. It will be possible to show which are the current shortcomings that are present in the market to be able to do so, and the benefits that this could represent for the country.
