Abstract: Los delitos cometidos a través de las TICs se han convertido en una amenaza mundial, por esta razón, los legisladores ecuatorianos han incorporado tipos penales que sancionen estos actos que afectan a la sociedad, siendo los niños, niñas y adolescentes el grupo más vulnerable al encontrarse expuestos a redes de pederastas que actúan por medio de las redes sociales, es así que, la figura encargada de combatir este ilícito es el Child Grooming, el cual, fue incorporado en los años noventa en el sistema anglosajón, en el año 2010 comenzaron a sumarse algunos países europeos, finalizando con América del Sur en el año 2011. Este antecedente histórico motivó a la legislación ecuatoriana a incorporar la figura del Child Grooming en el Código Orgánico Integral Penal vigente desde el año 2014, en el art. 173 que determina que el sujeto activo será cualquier persona mayor de dieciocho años, sujeto pasivo los niños, niñas y adolescentes y el verbo rector el contacto por medios electrónicos con una finalidad sexual, es así que, el tipo penal se encarga de proteger el bien jurídico indemnidad sexual que precautela el desarrollo físico y psicológico de los menores de edad. Technological development has caused a revolution in humankind. It has been positive sometimes, and in some other cases, it has affected legal assets by using technology to commit illicit conduct or acts that may put at risk vulnerable groups of any given society. That is the reason why, penalizing regulations and law must adapt to new ways of criminality. For example, Ecuador enacted The Comprehensive Organic Criminal Code (COIP) in 2014, which included several criminal types to sanction new ways of criminal offense through technology. That is the case of the section #173 of the law mentioned above, that protects children and youths welfare jeopardized constantly due to the easy access to ICT . Therefore, it is important to analyze the legal asset protected from this crime and, the historical background of child grooming too, through comparative law, in order to determine importance within the different bodies of criminal law.
