Requisitos constitucionales para la adopción de tratados bilaterales de inversión

Abstract

El propósito de esta tesis es dar a conocer las posibles contradicciones que expresan los Tratados Bilaterales de Inversión con nuestra constitución. Permitiéndonos tener una clara visión sobre la situación real del Ecuador ante estos instrumentos internacionales de tipo vinculante, que han sido utilizados en varias ocasiones para demandar al estado ecuatoriano por sumas que pueden significar una grave afectación a los intereses nacionales. Para esto la investigación parte en primer lugar de un análisis histórico del surgimiento y razón de ser de estos tratados, explicitando las condiciones políticas, económicas y jurídicas que determinaron su existencia y funcionamiento, en segundo lugar la tesis ahonda en las normas constitucionales e internacionales que cimentan la validez y adopción de los tratados internacionales y de este tipo de tratados de inversión en especifico.

The purpose of this thesis is to present the possible contradictions that express the Bilateral Investment Treaties with our constitution. Allowing us to have a clear vision of the real situation of Ecuador before these binding international instruments, which have been used repeatedly to sue the Ecuadorian State for sums that can mean heavy damage to national interests. In order to proceed with the research the first part of the investigation is a historical analysis of the emergence and rationale of these treaties, explaining the political, economic and legal conditions that determined their existence and operations, secondly the thesis goes deep in the constitutional and international standards that cement the validity and adoption of international treaties and of such investment treaties in specific. Subsequently, a comparative study of national legal rule and the substantive provisions of the Bilateral Investment Treaties, study that serves as a based framework for developing conclusions and recommendations that are intended as suggestions for a national positioning based around the theme of investment Treaties.
