Influencia de la opinión consultiva oc-24/17 de la corte interamericana de derechos humanos en la institución del matrimonio igualitario en Ecuador, periodo 2017 – 2020

Abstract

En el presente trabajo de titulación se abordará la Opinión Consultiva 24/17 de la Corte IDH sobre identidad de género, e igualdad y no discriminación a parejas del mismo sexo mediante el análisis de la estructura del documento y la presentación del impacto generado por el mismo a nivel regional, con la intención de comprender como se llevó a cabo el procedimiento consultivo y como el mismo genera bases internacionales en cuanto a Derechos Humanos en específico el derecho de igualdad y no discriminación hacia parejas del mismo sexo. Con respecto a este tema posteriormente se analizará la institución del matrimonio igualitario en el Ecuador repasando los antecedentes nacionales en materia de derechos de la población LGBTIQ. Después, se revisará el procedimiento legal llevado a cabo para la institución del matrimonio de parejas del mismo sexo en el país y se analizarán las sentencias emitidas por la Corte Constitucional del Ecuador para establecer este tipo de matrimonio. En último lugar, se analizará la repuesta a nivel interno tanto de las instituciones estatales como de la población sobre el reconocimiento del matrimonio igualitario en Ecuador.In this degree work, Advisory Opinion 24/17 of the Inter-American Court about gender identity, and equality and non-discrimination against same-sex couples will be addressed by analyzing the structure of the document and presenting the impact generated by it at a regional level. This with the intention of understanding how the consultative procedure was carried out and how it generates international bases in terms of Human Rights, specifically the right to equality and non-discrimination against same-sex couples. Regarding this issue, the institution of equal marriage in Ecuador will be analyzed, reviewing the national background of the rights of the LGBTIQ population. Subsequently, the legal procedure carried out for the institution of marriage of same-sex couples in the country will be reviewed and the judgments issued by the Constitutional Court of Ecuador to establish this type of marriage will be studied. Lastly, the internal response of both state institutions and the population regarding the recognition of equal marriage in Ecuador will be considered.
