Abstract: El presente trabajo se plantea como meta el análisis del estado de la independencia judicial y el control disciplinario a jueces en el Ecuador, post consulta popular y referéndum del año 2011. Para este fin se consideró pertinente hallar la razón de tener un órgano de control como lo es el Consejo de la Judicatura, visto desde la perspectiva de elementos como Estado de Derecho y Democracia, por otro lado, se procedió a analizar la importancia del principio de independencia judicial interna y externa y como este se ha visto vulnerado por la utilización de la figura del “error inexcusable” como causal de destitución de las y los servidores judiciales desde las funciones del Consejo de la Judicatura. El “error inexcusable” constituye un tema que sin lugar a duda ha generado muchas críticas y desconfianza en cuanto a su aplicación, ya que carece de definición y alcance dentro del Código Orgánico de la Función Judicial, y como se verá más adelante juzga criterios exclusivos de la actividad jurisdiccional.
The main goal of this dissertation is no analyze the actual state of the judicial independence and the disciplinary control applied to judges in Ecuador, as a point of reference for this study we will see what happened after the approbation of the “consulta popular y referendum” of 2011. It gets necessary to start analyzing the reason behind of having an institution like the “Consejo de la Judicatura” from the perspective of Rule of Law and Democracy, by the other hand we proceed to show the importance and need of the principle of judiciary independence and how this principle has been violated with the application of the “error inexcusable” as the main motivation for destitution of judges in Ecuador. The “error inexcusable” is a topic which has generated a lot of controversy and distrust among the society, because the legal definition isn’t determined in the law “Código Orgánico de la Función Judicial” precisely, later, we will show how the “Consejo de la Judicatura” judges exclusive criteria that belongs only to the judiciary scope.
