El sistema de control de constitucionalidad en el Ecuador

Abstract

El presente trabajo enfatiza en el análisis del control constitucional en el devenir histórico ecuatoriano; procurando identificar el tipo de configuración y las características que esta figura jurídica ha asumido al tenor de las circunstancias sociales, políticas y jurídicas. Estas situaciones han sido determinantes para la conformación del control constitucional entendido como la justicia constitucional tal como se conoce hoy en día. Finalmente se sitúa en la Constitución de 2008 evidenciando algunas contradicciones normativas que han sido sorteadas mediante la Ley y la jurisprudencia constitucional dando lugar a la plena aplicación del control constitucional concentrado en el Ecuador.

The present investigation emphasize the study of the constitutional control, through the Ecuadorian´s history; trying to identify the shape and the features that this legal figure has assumed due to social, political and legal circumstances. This situation had been decisive in order to define the constitutional control structure, just as how it is known nowadays. Finally, the constitutional control established in the 2008 Constitution, evidences some normative contradictions that have been resolved through the Law and the Constitutional precedents, allowing the constitutional control implementation focused on Ecuador.
