Abstract: La naturaleza como sujeto de derechos es una categoría problemática en cuanto significa una innovación en el plano jurídico tradicional. Aparece en la palestra pública fruto de las reivindicaciones indígenas y ecologistas de inicios de siglo y se constitucionaliza en Ecuador en el año 2008; hecho que ha sido altamente valorado por las organizaciones indígenas y ecologistas nacionales e internacionales, pero que no ha significado mayor garantía a la hora de proteger eficazmente sus derechos en los organismos jurisdiccionales. Es por ello que investigar su materialización normativa brindará pistas sobre la trascendencia de este nuevo sujeto en el campo jurídico. Para ello, la presente investigación, en un primer momento explora por las conceptualizaciones jurídico-filosóficas del término “sujeto”; posteriormente analiza la materialización normativa de la naturaleza como sujeto de derecho consignada en las sentencias de Cortes ecuatorianas y una sentencia de la Corte Constitucional de Colombia; finalmente establece dos tipos de conclusiones, las relativas al desarrollo teórico de la naturaleza como sujeto de derechos y las que dan cuenta de la situación actual del ordenamiento jurídico sobre el tema.
Nature as a subject of rights is a problematic category insofar as it means an innovation in the traditional legal level. It appears in the public arena as a result of the indigenous and environmental claims of the beginning of the century and was constitutionalized in Ecuador in 2008; This fact has been highly valued by national and international indigenous and environmental organizations, but has not meant a greater guarantee when it comes to effectively protecting their rights in jurisdictional bodies. That is why research into its normative materialization will provide clues about the importance of this new subject in the legal field. For this, the present investigation, at first explores by the legal-philosophical conceptualizations of the term "subject"; later, it analyzes the normative materialization of nature as a subject of law consigned in the judgments of the Ecuadorian Courts and a sentence of the Constitutional Court of Colombia; finally, it establishes two types of conclusions, those related to the theoretical development of nature as a subject of rights and those that account for the current status of the legal system on the subject.
