La restricción de la adopción sólo a parejas de distinto sexo en el ecuador frente al derecho del ser humano a no ser discriminado con base en la orientación sexual

Abstract

La presente investigación tiene como objeto de estudio el inciso 2º del artículo 68 de la Constitución de la República. Esta norma constitucional dispone que la adopción en el Ecuador se restringe sólo a las parejas de distinto sexo, hecho que, a nuestro criterio, puede vulnerar varios derechos constitucionales, entre ellos: la igualdad ante la ley y el derecho a no ser discriminado. Para analizar si efectivamente la restricción constitucional señalada vulnera otras normas constitucionales, se ha indagado en la doctrina especializada sobre la posibilidad de existencia de normas constitucionales inconstitucionales. Esta construcción doctrinaria, analiza el sistema de jerarquización normativa dentro de la propia constitución, herramienta argumentativa que nos permitirá determinar si existe una real vulneración de derechos tanto para las parejas del mismo sexo, a quienes se les prohíbe adoptar; como para los menores de edad a quienes se les niega la posibilidad de ser adoptados.

The following research is conducted on paragraph 2 in article 68 of the Constitution of the Republic. The objective is to show that this rule in Ecuador is restricted only to opposite-sex couples.
