La calificación de la admisibilidad, autenticidad y pertinencia de la prueba en el juicio Oral Penal

Abstract

La presente investigación trata del análisis jurídico-doctrinario orientado a resolver la cuestión de si: ¿Es adecuada la aplicación actual de las normas de admisibilidad de las pruebas, para garantizar la plena vigencia del debido proceso en el juicio oral? Para resolver ésta interrogante debemos contar con herramientas normativas que nos permitan determinar si la evidencia presentada en la etapa del juicio cumple con los requisitos de pertinencia y autenticidad, que la hagan admisible, y evitar que el tribunal juzgador se contamine con pruebas que lo lleve a cometer errores, por no ser científica, estar basada en prejuicios, por ser obtenida de manera ilegal e ilegítima; o para evitar que se presente prueba dilatoria o sobreabundante, que afecte la celeridad procesal...

This research deals with the legal and doctrinal analysis aimed at resolving the question whether: Is the current proper application of the rules of admissibility of evidence, to ensure the full observance of due process in the trial? To solve this question we must have policy tools that allow us to determine whether the evidence presented at the trial stage meets the requirements of relevance and authenticity, that make it admissible and prevent the trial court is contaminated with evidence that will lead to make mistakes, not to be scientific, it is based on prejudice, being obtained illegally and illegitimately; or to prevent this dilatory or superabundant proof that affect the celerity...
