Abstract: El trabajo investigativo tiene el objetivo de desarrollar desde el ámbito jurídico una experticia acerca de la utilización de software libre o propietario en la transferencia de tecnología en Ecuador, además de advertir cuál de los dos sistemas puede ser el más apropiado en las relaciones entre empresas privadas o públicas, la investigación también se centra en el análisis de licenciamientos y cual de este tipo de consentimientos resultarían más saludables para una mejor regulación legal del sector, con el fin de equilibrar y permitir la convivencia de derechos tan importantes en las sociedades contemporáneas como son los derechos de propiedad intelectual. De ahí que la investigación es importante e innovadora en la medida que los sectores tecnológicos en nuestro país han sido muy poco desarrollados y por ende el marco regulatorio y el debate jurídico muy escaso.
The research work aims to develop from the legal sphere, for expertise on the use of free software or proprietary in technology transfer in Ecuador, in addition to warning which of the two systems may be the most appropriate in relations between private companies or public, research also focuses on the analysis of licensing and what such consents would be healthier for better legal regulation of the sector, in order to balance and allow the coexistence of such important rights in contemporary societies as they are intellectual property rights. Hence research is important and innovative to the extent that technological sectors in our country have been poorly developed and therefore the regulatory framework and very little legal debate.
