dc.description.abstractEl propósito del presente trabajo de investigación implica el desarrollo del tema: NECESIDAD DE REFORMAR EL ART. 827 DEL CÓDIGO DE PROCEDIMIENTO CIVIL A FIN DE GARANTIZAR EL CUMPLIMIENTO DE LAS DECISIONES JUDICIALES, porque la falta de disposición legal para que se cumplan ciertas decisiones judiciales, en el juicio de exhibición permite que las mismas no sean acatadas, lo cual deja en indefensión a la parte actora de probar la existencia de la cosa, que es su propósito inmediato ver la cosa, para asegurarse que la misma se encuentra en poder de quien la tiene y este quien tiene que cumplir con la orden del Juez. Al haber culminado mis estudios superiores en la prestigiosa Escuela de Derecho de la Universidad Internacional del Ecuador, Sede Loja, y como persona útil a la sociedad he creído necesario realizar el presente estudio a la Institución Jurídica del JUICIO DE EXHIBICIÓN puesto que tal como se encuentra concebido el Art. 827 del Código de Procedimiento Civil deja en indefensión a quien solicita la exhibición del bien materia del litigio al no garantizar el bien jurídico protegido y permite que este acto incumpla con la decisión del Juez. Por estas consideraciones creo necesario e imprescindible que determinemos la necesidad de legislar convenientemente esta importante materia del Derecho Civil, para lograr los fines y metas que persigue la Ley, buscando reformas que estén dirigidas a la realización plena de la justicia y, a la vez presentar cambios que aporten ineludiblemente al mejoramiento de la justicia, tipificando adecuadamente a fin de que las decisiones adoptadas por el juez en el juicio de exhibición sean cumplidas por el requerido, puesto que con la sanción pecuniaria no se logra el fin de la justicia. El objetivo principal de esta investigación es demostrar que la sanción establecida en la sección vigésima segunda específicamente en el Art. 827 del Código de Procedimiento Civil en actual vigencia es sumamente sensible e insuficiente para cumplir con la exigencia del Juez. El método exegético. Perteneciente o relativo a la exégesis, muy útil en esta investigación jurídica, es interpretativo de las leyes, especialmente del Código de procedimiento Civil, muy usual en Derecho.es_ES
dc.description.abstractThe purpose of the present investigation work implies the development of the topic: NEED OF REFORM SECTION 22 OF TITLE II, BOOK II OF CIVIL PROCEDURE CODE TO ENSURE COMPLIANCE WITH THE COURT DECISIONS, because the lack of legal disposition so that certain judicial decisions are completed, in the exhibition trial it allows that the same ones are not accepted, that which stops in indefensión to the part actora to prove the existence of the thing that is their immediate purpose to see the thing, to make sure that the same one is in being able to of who has it and this who has to fulfill the Judge's order. When having culminated my superior studies in the noted School of Right of the International University of the Ecuador, Headquarters Loja, and I eat useful person to the society I have believed necessary to carry out the present study to the Artificial Institution of the TRIAL OF EXHIBITION since just as the Art it is conceived. 827 of the Code of Civil Procedure leave in indefensión to who requests the exhibition of the good matter from the litigation when not guaranteeing the very juridical one protected and it allows that this act incumpla with the Judge's decision. For these considerations I believe necessary and indispensable that determine the necessity to legislate this important matter of the Civil right meetly, to achieve the ends and goals that it pursues the Law, looking for reformations that are directed to the full realization of the justice and, at the same time to present changes that contribute unavoidably to the improvement of the justice, appropriately tipificando so that the decisions adopted by the judge in the exhibition trial are completed by the one required, since with the pecuniary sanction the end of the justice is not achieved. The main objective of this investigation is to demonstrate that the sanction settled down specifically in the twentieth section second in the Art. 827 of the Code of Civil Procedure in current validity are extremely sensitive and insufficient to fulfill the Judge's demand. The method exegético. Belonging or relative to the exegesis, very useful in this artificial investigation, it is interpretive of the laws, especially of the Code of Civil procedure, very usual in Right.es_ES
