Apreciación del intercambio electrónico de imágenes íntimas en la justicia constitucional ecuatoriana

Abstract

El análisis se enfoca en la vulneración de varios derechos fundamentales, como la protección de datos de carácter personal y autodeterminación informativa, honra y buen nombre, intimidad e imagen del titular, en los casos de difusión no autorizada de imágenes íntimas. Con este propósito se analiza los supuestos fácticos e interpretativos de la Sentencia 2064-14-EP/21, dictada por la Corte Constitucional del Ecuador, el 27 de enero de 2021. Específicamente; el estudio debate el alcance del consentimiento otorgado por el titular de imágenes íntimas que son compartidas con un tercero, en el sentido de que tal autorización únicamente habilita al destinatario a visualizar el contenido, pero no a compartir ni a realizar ninguna actividad que implique tratamiento de datos personales (Ripalda & Guerrero, 2023). The analysis focuses on the violation of several fundamental rights, such as the protection of personal data and informative self-determination, honor and good name, privacy and image of the owner, in cases of unauthorized dissemination of intimate images. With this purpose, it analyzes the factual and interpretative assumptions of Judgment 2064-14-EP/21, issued by the Constitutional Court of Ecuador, on January 27, 2021. Specifically, the study debates the scope of the consent given by the owner of images intimate information that is shared with a third person, in the sense that such authorization only enables the recipient to view the content, but not to share or carry out any activity that involves the processing of personal data (Ripalda & Guerrero, 2023).
