Cumplimiento del Estado ecuatoriano frente a la respuesta de la Comisión Interamericana de Derechos Humanos de la OEA respecto a las acciones llevadas a cabo en el paro nacional del 3 al 13 de octubre 2019

Abstract

Ante un evento de conmoción interna en un país, el Estado es el responsable de garantizar los derechos humanos, siendo estos esenciales para la humanidad. Asimismo, es importante el rol que cumplen las instituciones como la Comisión Interamericana de Derechos Humanos(CIDH), encargada de la observancia de estos en la región. En Ecuador, en octubre 2019,existió un evento que terminó con la represión y vulneración de derechos humanos. La presente investigación aborda los sucesos en el paro nacional de octubre 2019, haciendo énfasis en la respuesta de la CIDH a ese evento, evaluando su rol y determinando el cumplimiento del Estado ecuatoriano a través de sus diferentes instituciones frente a esta respuesta. Basándose en este estudio de caso (Paro Nacional 2019), se usa la teoría del neoliberalismo institucional para comprender la importancia del rol de las instituciones, como también evidenciar si en este caso la CIDH, como órgano institucional de la OEA, logró que se modifique el comportamiento del Estado ecuatoriano. Así, a lo largo, de esta investigación se identifica las medidas cumplidas por el Estado ecuatoriano y las que deberían ser puestas en marcha. In the event of an internal upheaval in a country, the State is responsible for guaranteeing human rights, which are essential for humanity. Likewise, the role played by institutions such as the Inter-American Commission on Human Rights (IACHR), responsible for the observance of human rights in the region, is important. In Ecuador, in October 2019, there was an event that ended with the repression and violation of human rights. This research addresses the events in the national strike of October 2019, emphasizing the response of the IACHR to this event, evaluating its role and determining the compliance of the Ecuadorian State through its different institutions in this response. Based on this case study (National Strike 2019), the theory of institutional neoliberalism is used to understand the importance of the role of institutions, as well as to demonstrate whether in this case the IACHR, as an institutional body of the OAS, managed to modify the behavior of the Ecuadorian State. Thus, throughout this research, the measures taken by the Ecuadorian State and those that should be implemented are identified.
