Un análisis comparativo entre ecuador y chile, libertad sindical y protección al despido de dirigentes sindicales

Abstract

La presente investigación, está enfocada en un análisis comparativo entre la legislación de Ecuador y Chile en materia sindical, con especial énfasis en los modelos de protección de la Libertad Sindical, referido al despido de los dirigentes sindicales. Para ello, se ha procedido a realizar un examen jurídico del Derecho Sindical en ambas legislaciones a través del estudio de las normas legales, constitucionales, como también las normas de rango internacional que regulan el tema, y que explican el por qué Chile, un Estado liberal ofrecería mayor protección sindical, que su símil Ecuador, considerado éste último como un modelo de Estado garantista de derechos y justicia.

This research is focused on a comparative analysis between the Ecuadorian and Chilean legislation related to labor union matters, with special emphasis on the protection models of trade-union freedom with respect to the dismissal of union leaders. Thus, a legal review of the Union Rights in both legislations has been carried out through the study of legal and constitutional regulations as well as the international regulations that govern the subject matter.
