Abstract: El presente trabajo de investigación, ha tenido como propósito hacer un breve recuento del cooperativismo antes y después de la Constitución de la República del Ecuador aprobada en el año 2008. Posterior a esto se efectúa un análisis sobre el marco legal ecuatoriano, el cual rige al sector cooperativo; en base a esto, se realizó un análisis de las ventajas y desventajas de los procesos de fusión efectuados por las organizaciones del segmento 5 del sector financiero popular y solidario como una alternativa al proceso de liquidación forzosa ordenado por la Superintendencia de Economía Popular y Solidaria. Esta medida como una opción propuesta por el Organismo de Control a las entidades del sector financiero popular y solidario con el propósito de asegurar su continuidad en el tiempo; sin embargo, en el desarrollo del presente trabajo de investigación se expondrán las ventajas y desventajas de estos procesos considerando la naturaleza de quienes conforman este sector de la economía ecuatoriana. El estudio del caso corresponde al proceso de fusión de 9 organizaciones de la economía popular y solidaria, que posteriormente sería llamada Cooperativa de Ahorro y Crédito Más Ahorro Solidario “MASCOOP”, la misma fue conformada por 8 cooperativas de ahorro y crédito y una caja de ahorro, socias de la Red de Estructuras Financieras Locales Alternativas “REFLA”. The present research work has had the purpose of making a brief account of the cooperativism before and after the Constitution of the Republic of Ecuador approved in 2008. After this an analysis is made about the Ecuadorian legal framework, which governs the cooperative sector; Based on this, an analysis was made of the advantages and disadvantages of the merger processes carried out by the organizations in segment 5 of the popular and solidary financial sector as an alternative to the compulsory liquidation process ordered by the Superintendencia de Economía Popular y Solidaria.
